Agreement between User and Orca-Arts.com

Welcome to orca-arts.com. The orca-arts.com website(the "Site") is comprised of various web pages operated by Orca Arts. orca-arts.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices herein (the "Terms"). Your use of orca-arts.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. We are not sure why you'd need or want to keep a copy of these terms, however we've been informed to include such verbiage so that both parties have been informed.

Privacy

Your use of orca-arts.com is subject to Orca Arts's Privacy Policy. Please review our Privacy Policy, which also governs the site snd informs of our data collection practices. Orca-Arts.com does collect cookies, however we don't do anything with them. It's more of a benefit for return visitors, and we're not in the business of collecting cookies, or data from our customers for money. Orca Arts only wants to sell and distribute the artwork featured on the website. 

Copyright

The artwork featured on Orca Arts is not allowed for any commercial or non-commercial use without proper consent from the artist or owner of the artwork. The artwork created and owned by the artists from Orca Arts own the copyright of the artwork featured on the website. Any use of the artwork, images, and information provided by Orca-Arts.com must have the approval of the artists or owners of the artwork.  

Electronic Communications

Visiting orca-arts.com or sending emails to Orca Arts constitutes electronic communications. You consent to receive electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing. 

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Orca Arts is not responsible for third party access to your account that results from the theft or misappropriation of your account. Orca Arts and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. Orca Arts reserves the right to cancel or terminate any account user at their discretion. Any bullying, hate-speech, or negativity perceived by Orca Arts will result in a permanent termination, and block.

Children Under Thirteen

Orca Arts does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use orca-arts.com only with permission of a parent or guardian. 

Cancelation/Refund

Orca Arts allows for 3 days from the date of purchase to cancel the order and receive 100% refund, after the order has shipped to the customer, any shipping costs accrued will be taken out of the refund. For a 100% refund, please contact Orca Arts as promptly as possible. After 30 days from the date of purchase, no refund will be granted. If any item that has been received by the customer, and needs to be returned, the customer should use the packaging the item was shipped in, and provide any additional packaging and payment for the shipping of the item back to Orca Arts. Once the item has been returned, and if the item has been received in the same condition, then a refund minus the initial shipping cost will be issued.
